General Conditions

OBJECTIVE
The purpose of these terms is to regulate sales transactions concluded with XALUCA CONFORT S.L. through this website. The contracting terms herein are duly registered in the General Terms Registry of the Mercantile Registry of Murcia.

PRODUCTS
The product descriptions on the website are based on information provided by XALUCA CONFORT S.L.'s suppliers. XALUCA CONFORT S.L. reserves the right to update the product offerings daily in accordance with market conditions.

CUSTOMERS
Any user becomes a Customer when they confirm their order.

EXECUTION OF DISTANCE CONTRACT
Unless otherwise agreed, the seller must fulfill the order without undue delay and no later than 6 calendar days from the conclusion of the contract.

NON‑FULFILLMENT OF DISTANCE CONTRACT
If the contracted good or service is unavailable, the consumer/customer must be informed and offered the following alternatives:

Wait for a new delivery timeframe
Choose a product of similar or higher characteristics
Request cancellation and full refund

ORDER PLACEMENT
To place an order, the user must complete the purchase form with their personal and payment details. Clicking the confirmation button signifies full acceptance of these terms. Upon receiving the order, XALUCA CONFORT S.L. will immediately send a confirmation email to the address provided.

PRICES
All prices are in euros and include applicable taxes. The price at the time of placing the order applies. Before confirming, XALUCA CONFORT S.L. will specify the cost breakdown. Offers will clearly show original and discounted prices. Prices may be changed at any time before order confirmation.

PAYMENT
Customers may pay by Visa or Bizum.
If requested, XALUCA CONFORT S.L. will issue an invoice (paper or electronic) by emailing shop@xalucaconfort.com.

CONTRACT FORMALIZATION AND COMPLAINT FORMS
The sales contract is formalized when the customer completes the purchase process and payment. Contractual obligations are fulfilled upon product delivery.
An invoice, terms and conditions, and withdrawal form will be sent via email and available in the customer's private area. The invoice will be retained as long as required by tax authorities.
Complaint forms are available at the company's registered office (C/ Las Tejeras 12, 30510 Yecla) or via shop@xalucaconfort.com.

DELIVERY

General preparation and delivery time: 2–6 working days (excluding weekends and local/national holidays) for orders before 13:00.
Orders after 13:00: delivery time extended by 24 hours.
Orders paid by bank transfer: 2 extra days for payment validation.
Deliveries to the Balearic Islands and Portugal: +6% handling fee and 1–3 additional days.
For shipments to Ceuta, Melilla, Canary Islands, Andorra: contact shop@xalucaconfort.com.
Delivery times may vary due to weather or force majeure. The carrier may also change to improve service.

SHIPPING COSTS
Shipping is free for all orders on this site.

CUSTOMER OBLIGATIONS
The customer must provide accurate information and a valid delivery address within normal delivery hours. XALUCA CONFORT S.L. is not responsible for delays due to incorrect addresses. The customer must use products lawfully. Breach may lead to order cancellation or product withdrawal without compensation.

RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within 14 calendar days of receiving the product without justification. This period expires 14 days after you or a third party indicated by you takes physical possession.

To exercise this right, notify XALUCA CONFORT S.L. (C/ Las Tejeras, 12 – Yecla, Murcia or shop@xalucaconfort.com) via clear statement (postal mail or email).
The withdrawal communication must be sent before the 14‑day period expires.

If you withdraw, we will reimburse the full amount within 14 calendar days of notification, using the same payment method unless otherwise specified. Reimbursement may be withheld until goods are returned or proof of return is provided.

You must return the goods within 14 days to XALUCA CONFORT S.L. (address above), at your expense. You only bear devaluation costs if handling exceeds what is necessary to verify the nature, characteristics, or functioning of the goods.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
Under Article 103 of Law 3/2014, the right of withdrawal does not apply to contracts relating to:

Services fully performed with prior express consent acknowledging withdrawal loss,
Goods priced by financial markets beyond seller’s control,
Custom-made/personalized goods,
Perishable goods,
Sealed goods that cannot be returned for health/hygiene reasons once unsealed,
Goods inseparably mixed after delivery,
Alcoholic beverages priced at contract with delivery after 30 days and market-dependent price,
Urgent repair/maintenance visits with additional services or parts,
Sealed sound/video recordings or software opened by consumer,
Daily newspapers, periodicals (except subscriptions),
Public auction contracts,
Services like accommodation, transport, vehicle rental, catering or leisure with a specific execution date/period,
Digital content not on material medium when execution started with explicit consent acknowledging loss of withdrawal right.

The right does not apply to sealed goods unsealed for health/hygiene reasons.

WARRANTIES
The seller is liable for defects arising within 3 years of delivery (as per invoice or delivery slip date).
Unless proven otherwise, defects within the first 2 years are presumed to have existed at delivery.
Consumers may demand, at no cost: repair, replacement, price reduction, or contract cancellation, including related expenses (shipping, labor, etc.).

PARTIAL NULLITY
If any clause is declared invalid, it does not affect the validity of the remaining provisions.
